{"id":3225,"date":"2019-06-12T21:34:10","date_gmt":"2019-06-13T01:34:10","guid":{"rendered":"https:\/\/www.gascon.ca\/2019\/06\/12\/short-term-rentals-important-amendments-to-the-regulation-respecting-tourist-accommodation-establishments\/"},"modified":"2019-06-12T21:48:58","modified_gmt":"2019-06-13T01:48:58","slug":"short-term-rentals-important-amendments-to-the-regulation-respecting-tourist-accommodation-establishments","status":"publish","type":"post","link":"https:\/\/gasc.sltm.ca\/en\/2019\/06\/12\/short-term-rentals-important-amendments-to-the-regulation-respecting-tourist-accommodation-establishments\/","title":{"rendered":"SHORT-TERM RENTALS: IMPORTANT AMENDMENTS TO THE REGULATION RESPECTING TOURIST ACCOMMODATION ESTABLISHMENTS"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>Following an announcement by\nthe Minister of Tourism on June&nbsp;5, 2019, the <em>Gazette Officielle du\nQu\u00e9bec<\/em> published June 12, 2019, the draft <em>Regulation modifying the<\/em> <em>regulation\nrespecting tourist accommodation establishments<\/em> (the \u201c<strong>Draft Regulation<\/strong>\u201d\nand the \u201c<strong>Regulation<\/strong>\u201d, respectively)<a href=\"#_ftn1\">[1]<\/a>. <\/p>\n\n\n\n<p>According to the Minister, the\nupdate of the applicable regulations regarding collaborative accommodations,\nsuch as \u201cAirbnb\u201d and \u201cHomeAway\u201d, will result in greater tax fairness between\nQu\u00e9bec citizens and will allow them to legally benefit from technological\ninnovations<a href=\"#_ftn2\">[2]<\/a>.<\/p>\n\n\n\n<p>The Draft Regulation provides\nfor the creation of a new class of tourist accommodation establishment called\nthe \u201cprincipal residence establishment\u201d (\u201c<em>\u00e9tablissement de residence\nprincipale<\/em>\u201d). This category consists of an establishment where\naccommodations are offered, by a single reservation, within the operator\u2019s\nprincipal residence to a person or single group of people together and where\nsuch accommodations do not include any meals served on-site<a href=\"#_ftn3\">[3]<\/a>.<\/p>\n\n\n\n<p>According to the Draft\nRegulation, a principal residence is the residence where an operator, a\nphysical person, resides on a regular basis and where its family and social\nactivities are concentrated, including when the residence is not used as a tourist\naccommodation establishment, and whose address corresponds to the address\nprovided by the operator to governmental authorities<a href=\"#_ftn4\">[4]<\/a>. The Draft\nRegulation does not provide for a maximum number of nights that can be offered\nby an operator.<\/p>\n\n\n\n<p>The operator of a principal\nresidence establishment will be able to apply for and obtain its classification\ncertificate provided by the Regulation, which will consist of a written notice\nincluding the establishment number, its category and its expiry date<a href=\"#_ftn5\">[5]<\/a>. The operator must\ninclude the establishment number in any advertisement (including any website)\nand in any short-term accommodation agreement<a href=\"#_ftn6\">[6]<\/a>.<\/p>\n\n\n\n<p>Pursuant to the Draft\nRegulation, if the establishment is located within an immovable held in\nco-ownership, the operator will be required to obtain and provide the\nauthorization of its co-ownership syndicate in order to obtain its\nclassification certificate. The same shall apply to an establishment governed\nby a residential lease: the tenant must obtain and provide the consent of its\nlandlord.<\/p>\n\n\n\n<p>What is notable is that the\nDraft Regulation removes the requirement that the unit is offered for rent to a\ntourist \u201con a regular basis in the same calendar year\u201d from the definition of\ntourist accommodation establishment provided under the Regulation, which was\nopen to interpretation. The Draft Regulation adds however that the availability\nof the unit is made public \u201cby using any media\u201d<a href=\"#_ftn7\">[7]<\/a>.<\/p>\n\n\n\n<p>Once the Draft Regulation is\nin force, the short-term rental of a secondary residence will continue to be prohibited,\nunless such residence is converted into an official tourist accommodation\nestablishment.<\/p>\n\n\n\n<p>Bear in mind that fines between $500 and $50,000 for a physical person and between $1,000 and $100,000 for a business can be imposed in the event of the failure to comply with the <em>Act respecting tourist accommodation establishments<\/em> and its Regulation.
